HABEAS CORPUS. - The argument
in the habeas corpus case of Dr. A. E. Peticolas, who prayed to be
delivered from the custody of the county justices, who had committed him for
alleged contempt in declining to testify in the matter of the late duel, was
commenced(?) yesterday. The Judge admitted the Dr. to bail and reserved his
decision. The question for him to decide is, whether or not the duelling law of
1860, obliging seconds, surgeons, &c., in duels, to testify, is constitutional.
It is the opinion of the bar,
that the Judge will declare the Act of Assembly unconstitutional, and discharge
Dr. Peticolas.
