SUPREME COURT - THE DUEL. -
This court was occupied Saturday and yesterday in hearing the argument in the
case of Pleasants, Sheriff of Henrico vs A. E. Peticolas.
This case, it will be
recollected, originated in an appeal taken by the County Court of Henrico from
the decision of Judge Meredith, who discharged Dr. Peticolas from a commitment
for contempt, in refusing to testify as a witness in the case of E. C. Elmore
and H. R. Pollard, charged with being concerned in a duel, in which J. M. Daniel
was alleged to have been shot.
The argument on Saturday was
on the preliminary question raised by Mr. Aylett, counsel for Dr. Peticolas, who
moved to dismiss the appeal upon the ground that, in a criminal case, the
Commonwealth was not entitled to a writ of error. Mr. Marshall spoke on the same
side yesterday.
